Terms of Use:


We’re glad to have you onboard as a Sploofs Artist-Vendor. Feel free to make yourself feel at home, but please adhere to the following rules. We try our best to make this experience the best it could be for all Sploofs Artists.

1. Accepting These Terms:

This document and the other documents that we reference below make up our house rules, or what we officially call our Terms of Use (the “Terms” for short).

The Terms are a legally binding contract between you and Sploofs (officially, Sploofs, LLC).

By agreeing to the Terms, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.

This contract sets out your rights and responsibilities when you use Sploofs.com and other services provided by Sploofs (we’ll refer to Sploofs.com and other services as our “Services”), so please read it carefully. By using any of our Services (even just browsing one of our websites), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services.

2. Seller’s (Artist’s) Responsibilities:

Sploofs’s Services connect people around the United States, both online and offline, to make, sell, and buy unique goods. We support artists by allowing them to become vendors on our online store. The artists that sell their work on our store are officially known as “Sploofs Artist-Vendors” (they will be referred to as Artists in this document). We also sell our own products independently of Artists. Here’s a handy guide to help you understand the specific rules that you are to follow when using our Services and the responsibilities you are to follow as an Artist:

As an Artist, you are given an account on Sploofs.com with which you are able to submit your own products, pictures, biography, store information, and personal information.

You are responsible for posting your information and coming up with your own prices, which are sent off to the Sploofs team to review and post. You may consult the team at Sploofs for help with this process. Your products should not and will not be published without our approval, unless otherwise stated in a formal, written agreement.

All products posted by Artists on Sploofs.com are to be sold on Sploofs.com. An Artist may not post or submit any products to Sploofs.com that Artist plans on selling elsewhere. This is to prevent customers of Sploofs.com from paying for an already sold item. Artist must indicate the correct number of products Artist has in stock when submitting, posting, and publishing a product.

Artist agrees to sell only their own work and nobody else’s work on Sploofs.com. Artist agrees that all their products are presented accurately by the posted pictures that correspond to each piece of work submitted.

Artist is responsible for shipping all sold works in a timely fashion (within 3 days of item being sold). Artist is responsible for shipping all of their own works that are sold. Artist is responsible for paying for shipments. Artist will only ship products within the United States and Canada. Artist is responsible for ensuring that customers that buy goods from Artist through Sploofs, are abiding by their own state or region’s regulations concerning tobacco products. Artist will only sell items related to tobacco use to customers that are 21 years or older. There must be someone 21 years or older to sign for purchased goods upon arrival to customer. Artist understands that they will have to cover shipping and handling costs and should price their products accordingly.

Artists may choose to terminate their use of Sploofs.com as Vendors at any time, but Artist must notify Sploofs.com at least 2 business days prior to termination.

Returns: Artists may or may not accept returns of unused items within 30 days of item being received by customer, but must inform Sploofs of their policy before selling items. Artist may not accept returns of used items. If sold work of art is determined (by Sploofs) as not having been accurately represented by corresponding pictures and description, Artist must accept return no matter what their return policy.

3. What Artists Can and Cannot Sell on Sploofs.com:

Artists can sell any functional or nonfunctional glass, ceramic, wood, or metal art on Sploofs.com as long as the art meets the following conditions:

  • Art is not made or intended to be used for any illegal purposes.
  • Art is not made or intended to be used for any federally illegal drug purposes.
  • Art cannot be advertised anywhere (Internet, Social Media, News Paper, etc.) as being made for or intended to be used for any illegal or federally illegal drug  purposes.
  • Art must be safe to use.
  • Art must be safe for use with tobacco products.
  • Being that Art is sold in a store with tobacco products, Art must only be sold to people over the age of 21.
  • Art must not be toxic, flammable, or otherwise dangerous to use.


4. Your Privacy and Our Permissions:

Sploofs will consult with Artist before beginning to publish any of the below stated material in this section (Section 4, “Your Privacy and Our Permissions”). Sploofs will attain separate approval from Artist before publicly displaying Artist’s products, pictures, biographical information, and store information. The following terms in this section apply once Artist agrees (verbally, in writing, or through email) to allow Sploofs to publish stated material:


Unless otherwise explicitly stated in writing, by agreeing to these Terms, Artist gives Sploofs permission to:

  • Publish all Artist’s submitted products, pictures, biographical information, and store information on Sploofs.com.
  • Publish all Artist’s submitted products, pictures, biographical information, and store information on all of Sploofs’ social media accounts.
  • Use Artist’s submitted products, pictures, biographical information, and store information to advertise Artist store or Sploofs.com in general.
  • Keep Artist’s submitted pictures and pictures of Artist’s products published and publically visible on Sploofs’ social media accounts after Artist terminates service or after Sploofs terminates Artist’s account.



Artist gives Sploofs permission to delete, edit, and alter any of Artist’s submitted products, pictures, or written information. Sploofs will be respectful to the Artist’s intention.


Artist gives Sploofs permission to delete Artist’s page, profile, and account for any reason whatsoever. Sploofs does not need to notify an Artist of any changes made to Artist’s account, including deletion, though Sploofs will maintain integrity and respect toward Artist.


Artist gives Sploofs permission to promote Artist through social media marketing, digital marketing, visual displays, and textual displays on Sploofs.com, and any other visual and textual promotions.


Artist understands that Sploofs’ advertisements of Artist and Artist’s products may bring additional traffic and attention to Sploofs and Sploofs.com, resulting in an increase in sales of other Sploofs.com products. Artist will not demand payment or compensation for any benefits brought by advertising or displaying Artist’s submitted products, pictures, biographical information, and store information, outside of the scope of sales of Artist’s own published products.

5. Payments and Fees:

Until further notice, Sploofs will transfer 100% of Artist sales to Artist via PayPal, electronic deposit, crypto currency, or check. Artist understands and accepts that Sploofs’ credit card processor, “Authorize” charges 3% commission per credit/debit card transaction. Sploofs will subsidize this charge until further notice, upon which time responsibility to pay this 3% commission charge may transfer to Artist. In that case Artist will receive the total sale price (x) for his sold piece minus Authorize’s card processing fee (f) or (x-f = Artist’s payout). Artist understands that Sploofs will subsidize this cost until further notice, upon which time this cost will be automatically deducted from the Artist’s payment.


Sploofs will transfer this money to Artist once sales is made and item is shipped. Artist must provide Sploofs with proof of shipment i.e. picture of sent package and shipping identification number. Sploofs may withhold payments to Artist if we believe Artist has violated our terms and conditions. Artist understands that payments may take 14 days or longer after shipment of product to transfer to Artist. Artist understands that Sploofs is not responsible for whatever fees Artist incurs from their payment processor i.e. PayPal.


If customer’s payment does not go through for whatever reason, Sploofs may withhold payment to artist until issue is resolved.


  1. We reserve the right, in our sole discretion, to seek reimbursement from a seller in any of the following circumstances: (a) we provide a refund to a buyer because a seller did not promptly deliver the goods or we otherwise determine, that a refund is warranted in a particular circumstance, (b) we discover erroneous or duplicate transactions related to a seller, (c) we receive a chargeback from a buyer’s credit card issuer or reversal of payment for the amount of a buyer’s purchase from a seller, or (d) a seller does not act in accordance with Sploofs’ Terms of Use or any policy thereunder.
  2. We may obtain reimbursement of any amounts owed by a seller to Sploofs by deducting from future payments owed to the seller, reversing any credits to the seller’s payment account balance, charging the seller’s credit card on file, charging the seller’s bill, or seeking reimbursement from the seller by any other lawful means, including by using third-party collections services. You authorize us to use any or all of the foregoing methods to seek reimbursement.

6. Other Points:

These Terms are applicable until Sploofs updates Sploofs Seller Terms (terms and condition), upon which time, Artist will receive notice.[/vc_column_text][ninja_form id=”2″][/vc_column][/vc_row]
